NonProfit organizations provide the community with a public service and benefits from enhancing needy families’ quality of life to complementing government services. Organizations granted tax-exempt status may be exempt from federal taxes, sales taxes and property taxes, even payroll taxes if organization has employees.

To subsidize the expenses of administration of the organization, tax exempt organizations may apply for grants, solicit donations, accept both cash and in-kind contributions; all while benefiting the contributors with tax benefits. Being tax-exempt will save organization money and resources over time.

● Charitable, Religious, Educational, Scientific, etc. Organizations 501(c)(3) ● Civic Leagues and Social Welfare Organizations 501(c)(4) ● Labor, Agricultural, and Horticultural Organizations 501(c)(5) ● Business Leagues, Etc 501(c)(6)

The organization must take the following 4 steps prior to applying for tax-exemption: 1. Organization must determine if it is a trust, a corporation or an association 2. Gather organizational documents (determine bylaws, articles of incorporation, etc.) 3. Obtain Employer ID Number 4. Register as a non-profit organization with their respective state and meet any registration requirements.

Once the above 4 steps are complete, organization may apply for tax exemption. Each category of tax-exemption has specific application and compliance requirements dictated by the Internal Revenue Service.

Tax-exempt organizations are required to submit a financial report form 990 every year by the 15th of the fifth month from the end of the organization’s end of tax year. Compliance with this requirement is extremely important as it will determine if your organization will continue to enjoy the many benefits of having an active status.

But what happens when compliance fails? If Form 990 is not filed for 3 consecutive years, the tax-exempt status will be automatically revoked. If status has been revoked for the first time, you have only one opportunity to reinstate the tax-exempt status. Is your organization on the Automatically Revoked Tax-Exemption List?
